URGENT UPDATE TO NEW REGISTRATIONS:

Hello, below is an update on Registration:

On August 3, 2015, the Superior Court of Quebec announced its decision in the Descheneaux case. The Court ruled that paragraphs 6(1)(a), (c) and (f), and sub-section 6(2) of the Indian Act violate equality rights under the Canadian Charter of Rights and Freedoms because they perpetuate a difference in how Indian status is acquired and transmitted between Indian men and Indian women.

Bill S-3, An Act to amend the Indian Act was introduced on October 25, 2016 to address known sex-based inequities in Indian registration under the Indian Act in response the Superior Court of Quebec decision in Descheneaux c. Canada.

Bill S-3 was not passed by the Senate before rising for the summer recess on June 22, 2017, and therefore, did not receive Royal Assent by the Court-ordered deadline of July 3, 2017.

Following the decision of the Superior Court of Quebec denying the Government of Canada’s request for an extension, Canada filed an appeal with the Quebec Court of Appeal on June 29, 2017. On July 3, 2017, the appeal court granted a brief suspension of the decision until August 9, 2017 when it will hear the substantive issues of the appeal such as the impact on individuals applying for registration as Status Indians during a period of time that INAC would have no legislative authority to register people.

Applications will continue to be processed as per normal procedures up to August 9, 2017 and beyond if the Quebec Court of Appeals grants another extension based on its consideration of all the issues in play.

In the absence of a court extension of the suspension of the decision, the registration provisions of the Indian Act become inoperative and INAC will be unable to register individuals seeking Indian status across Canada on August 9, 2017.

However, should the Court decide it will not grant another extension, the Indian Registrar has made the determination that although INAC will continue to accept applications for registration, they will remain on hold until such time as the parliamentary process resumes in the autumn of 2017 and new legislation comes into force.

 

In the interim, the Department will continue to look at options to minimize the impact it will have on individuals applying for registration.

Whenever there are changes to legislation, such as the Indian Act, Parliament (the House of Commons and the Senate) need time to review and approve the Bill so it can receive Royal Assent, or in other words, become law.

Due to procedural rules governing Parliamentarians and how long they wish to debate at each stage of the legislative process, it is impossible to determine precisely how much time it will take any bill to receive Royal Asset.

Although Bill S-3 was not passed by the Senate before rising for the summer recess on June 22, 2017, it will remain on their agenda for the autumn session.

The Government remains committed to eliminating sex-based inequities in Indian registration.

The Saddle Lake Cree Nation Membership Department is a full service department for the membership of the Saddle Lake Cree Nation. Saddle Lake Cree Nation is a Section 11 Departmentally Controlled Band, with 2 separate Administrations geographically identified as Saddle Lake #125, and Whitefish Lake #128. With the existence of two separate Administrations, one membership list is maintained at INAC, which contains all members in all INAC reference identification categories. Also, the membership Department maintains and prepares eligible membership list for any conducted Tribal Custom Elections exercises with the community.

Since June 2010 the Membership Department has expanded and recognized by the INAC to provide service at the community level for the Membership of Saddle Lake Cree Naiton. Briefly at this time the Saddle Lake Membership Department offers service in the following areas:

 

BIRTH REGISTRATIONS FOR MEMBERSHIP: Requirement is long form Birth Certificate, with parental information in order to register for membership, INAC Parental Statement of Consent with signature of BOTH parents.

CERTIFICATE OF INDIAN STATUS (C.I.S) laminate cards was a service granted to the Sadde Lake Membership Department by INAC in conjunction with direct access to our full membership list which identified as the Indian Registration System (I.R.S) – Prior to issuance of a C.I.S prior is identity is required and completion of Application for C.I.S

OTHER SERVICES PROVIDED: Band Membership Transfers, Updates and Notices of Marriage, Divorces, Deaths, Name Changes, Age of Majority requests and also  inquiry assistance in any matters that pertain and reflect on membership.
